Terms of Service

These Terms of Service ("Terms") govern your access to and use of the CallBro website (callbro.ai), desktop application, and related services (collectively, the "Service") provided by CallBro ("we," "us," or "our").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

CallBro is a desktop application and web platform that captures audio from meetings, generates real-time transcriptions using third-party speech-to-text providers, and produces AI-enhanced notes, summaries, and chat responses using third-party large language model (LLM) providers.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into these Terms. By using the Service, you represent that you meet these requirements.

3. Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and keep it up to date. We may suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to:

  • Use the Service to violate any applicable law or regulation.
  • Record conversations without the consent of participants where required by law. You are solely responsible for compliance with all applicable recording, wiretapping, and consent laws in your jurisdiction.
  • Upload or transmit content that infringes third-party intellectual property rights.
  • Attempt to reverse-engineer, decompile, or extract source code from the Service.
  • Use the Service to generate content that is illegal, harmful, abusive, or violates the rights of others.
  • Circumvent usage limits, authentication, or security measures.
  • Resell or redistribute the Service without our written consent.

5. Your Content

You retain ownership of content you create or upload ("Your Content"), including transcripts, notes, and chat messages. By using the Service, you grant us a limited, non-exclusive license to process, store, and transmit Your Content solely to provide and improve the Service.

When you enable public sharing for a record, the title and enhanced note become publicly accessible via a link. You are solely responsible for what you share.

6. Third-Party Services

The Service relies on third-party providers for core functionality, including but not limited to:

  • Soniox — speech-to-text transcription
  • OpenRouter and downstream LLM providers (Google Gemini, OpenAI, etc.) — AI features
  • Google — OAuth authentication
  • Postmark — transactional email
  • PostHog and Google Analytics — product analytics

WE DO NOT CONTROL THIRD-PARTY SERVICES AND ARE NOT RESPONSIBLE FOR THEIR AVAILABILITY, ACCURACY, PERFORMANCE, DATA HANDLING, SECURITY, OR COMPLIANCE. Third-party services are subject to their own terms and privacy policies. Interruptions, errors, or policy changes by third-party providers may affect the Service, and we shall have no liability for such events.

By using the Service, you acknowledge and consent to the transmission of your data (including audio, text, and metadata) to these third-party providers as necessary to deliver the Service.

7. AI Output Disclaimer

AI features (transcription, note generation, summaries, chat responses) are generated by third-party machine learning models. AI output may be inaccurate, incomplete, misleading, or contain errors.

  • AI output does not constitute professional, legal, medical, financial, or any other form of advice.
  • You are solely responsible for reviewing, verifying, and acting upon any AI-generated content.
  • We make no representations or warranties regarding the accuracy, reliability, or fitness of AI output for any purpose.

8. Recording and Consent

CallBro captures audio from your microphone and, optionally, from system audio output. You are solely and exclusively responsible for:

  • Obtaining all necessary consents from meeting participants before recording.
  • Complying with all applicable laws regarding audio recording, surveillance, and wiretapping in your jurisdiction and the jurisdictions of all participants.
  • Understanding that recording without consent may be illegal in your jurisdiction.

We accept no responsibility or liability for your failure to obtain required consents or for any legal consequences arising from your use of the recording features.

9. Fees and Payment

Certain features of the Service may require payment. Pricing is described on our website. We reserve the right to change pricing at any time. If you do not agree with a price change, your remedy is to stop using the Service.

In the European Union and other jurisdictions where applicable, you may have a statutory right to withdraw from the contract within 14 days for digital content or services. To request a refund, contact us at contact@callbro.ai. We will process refund requests in accordance with applicable law, and we may refuse or limit refunds where we reasonably believe the right of withdrawal is being abused.

10. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE — INCLUDING ALL CONTENT, FEATURES, AI OUTPUT, TRANSCRIPTIONS, AND FUNCTIONALITY — IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OR COMPLETENESS OF CONTENT OR AI OUTPUT, UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE OPERATION, AND THAT DEFECTS WILL BE CORRECTED OR THAT THE SERVICE WILL MEET YOUR REQUIREMENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CALLBRO, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, OR COST OF PROCUREMENT OF SUBSTITUTE SERVICES.

THIS INCLUDES DAMAGES ARISING FROM: (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) ANY AI OUTPUT, TRANSCRIPTION, OR CONTENT GENERATED BY THE SERVICE; (C) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; (D) ACTIONS OR OMISSIONS OF THIRD-PARTY SERVICE PROVIDERS; (E) ANY OTHER MATTER RELATING TO THE SERVICE — WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.

OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) AMOUNTS YOU PAID TO US DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY US DOLLARS (USD $50).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless CallBro, its affiliates, and their respective directors, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, Your Content, your violation of these Terms, your violation of any applicable law (including recording consent laws), or your violation of any third-party rights.

13. Suspension and Termination

We may suspend or terminate your access to the Service at any time, for any reason or no reason, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination — including Disclaimers, Limitation of Liability, Indemnification, and Governing Law — shall survive.

You may delete your account at any time by contacting contact@callbro.ai.

14. Modifications

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting updated Terms on our website. Your continued use of the Service after changes constitutes acceptance of the revised Terms. If you do not agree, stop using the Service.

15. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kazakhstan, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Republic of Kazakhstan.

16. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and CallBro regarding the Service and supersede all prior agreements.
